Terms of Service

Kerb Side is a free platform for giving away items you no longer need to people nearby. It is not a marketplace. Nothing listed on Kerb Side may be sold, swapped, traded, or offered in exchange for money, koha, favours or anything else of value.

Kerb Side is free to use and always will be. We take no commission and process no payments.

Kerb Side operates between 6:00 am and 6:00 pm New Zealand time. Outside those hours the service is closed: no listings are visible, and items cannot be posted or taken.

• You must be at least 16 years old to create an account.
• Provide accurate information, and keep your password to yourself.
• One account per person. Duplicate accounts may be removed.
• You are responsible for what happens under your account.

When you post an item you confirm that:

• It is yours to give away.
• It is free — there is no charge, fee, donation or exchange of any kind.
• It is legal and safe to pass on under New Zealand law.
• It is not on our prohibited items list.
• Your description and photos honestly represent the item and its condition.
• You have the right to allow someone to come to the collection address you provide.

Items may only be posted between 6:00 am and 5:00 pm. Listings stay live for 4 hours or until 6:00 pm, whichever comes first. After that we ask whether the item is still available; you can renew it up to 3 times within the same day.

At 6:00 pm every listing is removed from the feed. Listings do not automatically return the next day — if you still want to give the item away, you must relist it yourself after 6:00 am. A listing left unrelisted for 7 days is retired, and the collection address we hold for it is deleted.

Saying you’re keen on an item is a genuine commitment to collect it. When you do, you receive a stranger's home address and the item is taken out of the feed for everyone else — so please only say you’re keen on what you can actually pick up.

• You may only say you’re keen on something between 6:00 am and 5:00 pm.
• Collect by 6:00 pm the same day, or say you’re no longer keen so someone else can have it. This deadline applies however late in the day you said so.
• Keep the collection address private. Do not share it, post it, or use it for anything other than collecting the item.
• Do not phone, text or message the other person, and do not ask them to contact you. Everything needed to collect an item is provided automatically, and Kerb Side deliberately has no messaging.
• Collect only from the spot named in the collection notes. You must not knock, ring the bell, or enter any part of the property. The address is given to you to find the item, not to approach the household.
• Being keen is not a guarantee the item will be there. Items are left out in the open where any member of the public may take one. If it has gone when you arrive, say you’re no longer keen — do not knock to ask about it.
• Repeatedly saying you’re keen and not collecting will lead to a warning and then a temporary restriction.

Any attempt to sell, charge for, or seek payment in connection with a Kerb Side listing is a breach of these terms. This includes asking for money after someone is keen on an item, requesting a “koha”, or directing people off Kerb Side to complete a transaction. Listings that attempt this are blocked automatically, and repeat attempts lead to account suspension.

Kerb Side connects neighbours, but we do not verify members' identities and we cannot vet items. Use your own judgement: collect in daylight where you can, bring someone with you if you would prefer, and check that an item is safe before you use it. Items are given away as-is, with no warranty of any kind.

Items are left in publicly accessible places, so Kerb Side cannot guarantee that an item will still be there when you arrive — a passer-by with no Kerb Side account may simply have taken it. Saying you’re keen reserves an item on this platform; it does not reserve the item in the physical world, and a wasted trip is not something we can make good.

Kerb Side is a platform, not a party to any giveaway. We are not liable for the condition or safety of items, for whether an item is still present, or for what happens during a collection, to the extent permitted by law. Nothing in these terms limits rights you have that cannot lawfully be excluded, including under the Consumer Guarantees Act 1993 where it applies.

We may remove any listing and suspend or close any account that breaches these terms, our community guidelines, or the prohibited items policy. Serious breaches — weapons, drugs, stolen property, threats — result in immediate removal and may be reported to New Zealand Police.

You keep ownership of the photos and text you post. You grant Kerb Side a licence to display them on the platform for as long as your listing is live. That licence ends when your listing is removed.

We may update these terms. If a change is significant we will let you know in the app before it takes effect.

These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction over any dispute.
